THESE ‘’LOTTO’’ RULES APPLY FROM 3rd October 2015

1. DEFINITIONS
"Bonus Ball" means the number randomly selected from the remaining forty-three numbers in the Draw immediately after the Correct Numbers have been selected.

Charities Trust’’ means the Charities Trust, Registered Charity No. 327489.  Promoter: Euan Imrie, Charities Trust, Suite 22, Century Building, Brunswick Business Park, Tower Street, Liverpool L3 4BJ.

Correct Number” means any one of the first six numbers randomly selected in a Draw (excluding the Bonus Ball).

‘‘Customer’’ means any person (or group, partnership or syndicate of persons) who places an Entry.

Draw” means each main ‘German Lotto 6aus49’ draw operated by Deutscher Lotto and Toto Block  and currently held on Saturday and Wednesday (or any day substituted for either day) which culminates in the selection of a set of Correct Numbers and one Bonus Ball on a random basis.

"Entry" means a Play Slip which has been completed and submitted by a Means of Entry and is accompanied by the correct Payment and accepted by the Game Operators in accordance with these Rules.

"Game" means each of the following society lottery games in which the distribution of prizes is determined by reference to the matching of a Customer’s selection of numbers with the Correct Numbers in a specific Draw:
(i) the "One Number Lottery", where to be eligible for a prize a Customer's Entry must contain a Line with one Correct Number;
(ii) the "Two Number Lottery", where to be eligible for a prize a Customer's Entry must contain a Line with two Correct Numbers;
(iii) the "Three Number Lottery", where to be eligible for a prize a Customer's Entry must contain a Line with three Correct Numbers; and
(iv) the "Four Number Lottery", where to be eligible for a prize a Customer's Entry must contain a Line with three Correct Numbers or four Correct Numbers (as explained further in paragraph 4.3 below).

"Game Operators" means (i) the Lottery Manager; and (ii) TFP.  References in these Rules to "We", "Our" or "Us" shall mean the Games Operators.

"Line" means each single or combination of numbers selected by a Customer from the Play Area in relation to a particular Game and Draw.

Lottery Manager” means UK Lottery Management Limited.

"Means of Entry" means the means of transmission and receipt by which Entry is accepted from time to time including (without limitation) by a collector, the internet, post or by telephone.

"Payment" means the total sum paid by the Customer in respect of each Entry made.

"Payment per Line" means £1 (one pound).

Play Area” means each list of the numbers 1 to 49 inclusive on a Play Slip from which a Customer can make a selection of Lines.

Play Slip” means a pre-printed document, or online version of the same, made available by the Game Operators and containing one or more Play Areas.

TFP” means The Football Pools, which is a trading name of The Football Pools Limited, a company registered in England and Wales with company number 00545018 and whose registered office is at Walton House, Charnock Road, Liverpool, L67 1AA.

"Website" means the website as referred to in the Means of Entry applicable to a Customer’s Entry. Please refer to the Means of Entry Rules.

"Winning Line" means in relation to each Game, a Line containing the required number of Correct Numbers in order to win a prize.

"Winnings" means an amount payable to a Customer in respect of a Winning Line in a Game.

2. GENERAL
2.1 The Games are provided by the Lottery Manager in conjunction with TFP. For the avoidance of doubt, neither "Lotto" nor any of the Games form any part of the National Lottery.  The Laws of England including the Gambling Act 2005 apply to these Rules and to all Games conducted under them.

2.2 Each Means of Entry will set out the age at which a Customer is allowed to place an Entry.

2.3 These Rules govern the operation of the Game irrespective of the Means of Entry.

2.4 The Lottery Manager reserves the right to amend these Rules without notice and/or suspend its acceptance of Entries in relation to any Game (or any part of it) in the event of war, earthquake, catastrophe, strikes or the occurrence of any other event beyond our reasonable control.

2.5 Despite every effort to ensure complete accuracy, the Lottery Manager cannot be held responsible for any typing, human or obvious error which leads to any errors or omissions by us including (without limitation) the incorrect announcement of prizes or results, or the mistaken acceptance of an Entry which contravenes these Rules. If any Entry is affected by such an error, it shall be accepted on the basis of the relevant affected information as corrected by the Lottery Manager or, if this is not possible, the Payment will be refunded.

2.6 The Lottery Manager reserves the absolute right at any time to withdraw this Game (or any part of it) and in such circumstances will refund all affected Payments paid in advance.

2.7 The Customer is not permitted to call at the premises of the Lottery Manager to deliver an Entry.

3. SENDING IN ENTRIES AND PAYMENTS
3.1 To constitute an accepted Entry, such Entry must be submitted in accordance with and by the date set out on the Means of Entry and in accordance with these Rules.

3.2 Each Entry will be accepted in respect of the Draw that takes place on the date indicated on the Play Slip and, where the Customer chooses to place an Entry in relation to more than one Draw, for the number of consecutive Draws selected.  If an Entry is received in respect of a particular Draw after the date on which such Draw takes place, then (despite any other indication of the Customer's intention), the Entry will be disqualified (and Payment refunded) unless we, in our absolute discretion, decide to accept the Entry by entering it into the next Draw that takes place thereafter (and the indicated number of Draws after that if the Customer has chosen to place such Entry in relation to more than one Draw).

3.3 Where a Play Slip allows a Customer to choose numbers from the Play Area for entry into more than one Game but the Customer fails to indicate in the manner specified on the Play Slip such an intention (despite any other indication of the Customer's intention) or the Payment enclosed is inconsistent with the Game(s) chosen, the Draws indicated and/or the Lines selected, the Entry will be disqualified (and Payment refunded) unless we, in our absolute discretion, are able to make the necessary changes in order to accept the Entry, for example, by reference to the Payment associated with the Play Slip.

3.4 Customers acknowledge and agree that neither the Lottery Manager nor TFP accept any responsibility to Customers in respect of entries that are incorrectly submitted or accepted under paragraphs 3.2 or 3.3 above, either in relation to (i) notifying any Customer that an Entry was incorrect or (ii) how such incorrect Entry is dealt with by us, although both the Lottery Manager and TFP are committed to treating Customers in the most fair manner possible.

4. PRIZES
4.1 Subject to paragraph 4.2, the prize fund for each Game shall be 45% of the Payments received by us in respect of that Game. The value of the prizes for each Game will therefore be dependent on the amount of Payments received in respect of the relevant Game.  At least 20% of the Payments received for each Game will go to the Charities Trust.

4.2 The prize fund available in respect of each Game may not exceed the higher of £25,000 or 10% of the Payments made in respect of that Game.  If the Payments received in relation to any Game exceed these amounts, leading to the creation of a surplus, such surplus shall be paid to the Charities Trust.

4.3 Winnings shall be awarded as follows:

One Number Lottery (“Lotto 1”)
4.3.1 Each Line entered into a One Number Lottery Game that consists of 1 Correct Number will entitle the Customer who submitted the Entry containing such Line to a share of that Game's prize fund (calculated by dividing the total available prize fund for each such Game by the number of Winning Lines in that Game).

4.3.2 If no Entry to the One Number Lottery Game contains a Line consisting of 1 Correct Number, that Game's prize fund will be paid to the Charities Trust.

Two Number Lottery (“Lotto 2”)
4.3.3 Each Line entered into a Two Number Lottery Game that consists of 2 Correct Numbers will entitle the Customer who submitted the Entry containing such Line to a share of that Game's prize fund (calculated by dividing the total available prize fund for each such Game by the number of Winning Lines in that Game).

4.3.4 If no Entry to the Two Number Lottery Game contains a Line consisting of 2 Correct Numbers, that Game's prize fund will be paid to the Charities Trust.

Three Number Lottery (“Lotto 3”)
4.3.5 Each Line entered into a Three Number Lottery Game that consists of 3 Correct Numbers will entitle the Customer who submitted the Entry containing such Line to a share of that Game's prize fund (calculated by dividing the total available prize fund for each such Game by the number of Winning Lines in that Game).

4.3.6 If no Entry to the Three Number Lottery Game contains a Line consisting of 3 Correct Numbers, that Game's prize fund will be paid to the Charities Trust.

Four Number Lottery (“Lotto 4”)
4.3.7 Each Line entered into a Four Number Lottery Game that consists of 3 Correct Numbers will entitle the Customer who submitted the Entry containing such Line to at least £20 in respect of that game (see paragraph 4.3.8 below for circumstances where more than £20 may be paid), unless, after allocating the prizes for 3 correct numbers, the calculated prize for 4 Correct Numbers (as referred to in paragraph

4.3.8 below) is £20 or lower, in which circumstances we reserve the right to reduce the prize payable under this paragraph 4.3.7 for Winning Lines with 3 Correct Numbers.

4.3.8 Each Line entered into a Four Number Lottery Game that consists of 4 Correct Numbers will entitle the Customer who submitted the Entry containing such Line to a share of that Game's prize fund (which shall be calculated by deducting from the total available prize fund for that Game an amount equal to the value of the prizes paid out under paragraph 4.3.7 above and then dividing the remaining amount by the number of Winning Lines consisting of 4 Correct Numbers).

4.3.9 For the avoidance of doubt, Customers who are entitled to Winnings pursuant to paragraph 4.3.8 above, are not also entitled to Winnings under paragraph 4.3.7.

4.3.10 If no Entry to a Four Number Lottery Game contains a Line consisting of 4 Correct Numbers, that Game's prize fund shall be allocated to those Lines entered into the Four Number Lottery Game that consist of 3 Correct Numbers, which will entitle Customers who submitted the Entry containing such Line to a share of that Game's prize fund (calculated by dividing the total available prize fund for that Game by the number of Winning Lines in that Game).

4.3.11 If no Entry to a Four Number Lottery Game contains a Line consisting of 4 Correct Numbers and no Entry to the same Four Number Lottery Game contains a Line consisting of 3 Correct Numbers, that Game's prize fund will be paid to the Charities Trust.

5. CANCELLED DRAWS
If a Draw is cancelled we shall notify you online via the Website. Entries will be valid for and automatically entered into the next available Draw.

6. CONDITIONS OF ACCEPTANCE
6.1 Notwithstanding anything to the contrary in these Rules, we reserve the right to refuse to accept or to disqualify an Entry if such Entry:
i. Is not accompanied by the required Payment;
ii. Is not received and accepted by the Game operator in accordance with these Rules;
iii. Is not, or may not be, genuine;
iv. Is sent by a person under the age required for the particular Means of Entry;
v. Is lost, interrupted or affected by the non-availability or malfunction of any server or other form of connection;
vi. Appears to be jumbled, scrambled or misdirected by any kind of electronic or mechanical failure;
vii. Is ambiguous, illegible or incomprehensible
viii. Is made by or on behalf of an employee of a company in the Sportech PLC group, or anyone acting in concert with such employee; or
ix. Breaches any of these Rules in relation to an Entry or the terms and conditions set out in the Means of Entry.
6.2 If we disqualify an Entry or otherwise refuse to accept a Play Slip we will return or credit the relevant Customer with any payment we have received.

7. MATTERS AFFECTING THE OPERATION OF ‘‘LOTTO’’ 
We reserve the right to discontinue any Game at any time but will honour any valid Entries already received prior to the date on which such discontinuation becomes effective.

8. RULE CHANGES
Any amendment to these Rules will be notified online at the Website. A Customer's continued participation in the Game following such notification shall be deemed to constitute acceptance of the amended Rules.
